Below is a copy of our standard contract / terms and conditions that applies to all reservations and our privacy policy. Please be aware that by making a deposit (or full) payment to us for a contracted tour you will be registering the acceptance of every clause for yourself and each member of your travel party, no signature(s) is (are) necessary.

Our trips are operated by third-parties whom we contract on your behalf – our obligation is to provide the best OPERATORS in the market relative to the established price. The OPERATORS must be legally established and authorized to operate in agreement with Ecuadorian law.

NICKY LODGE would also like to state that whilst both we and our clients are bound by the legal contract below, we will always do everything possible to help and support our clients in the event of any pre-tour or on-tour problems – in fact we have an envied reputation of going above and beyond to help our clients out. We are also able to assist with documentation to assist with insurance claims.

  1.  FIRST CLAUSE – Cancellation Policy

Nicky Lodge Tour Cancellations

We put a lot of effort in organising tours; therefore cancellations require 24 hours’ notice. If you wish to cancel a tour operated directly by Nicky Lodge and you give more than 24 hours’ notice, we will provide you with a 50% refund. If cancellations are made within any shorter notice than 24 hours, you will not be provided with a refund.

Unfortunately, in certain situations we may need to cancel your tour. In this case, we will do our best to contact you in order to advise you of the cancellation. You will be entitled to a full monetary refund, or a replacement tour if available.

Outside Tour Cancellations

If you wish to cancel a tour that is not directly operated by Nicky Lodge, the cancellation policy of the specific tour operator or service provider will apply.

Flight Cancellations

Due to the cancellation policies of flight operators, we are unable to offer you a refund as soon as your flights are booked.

  1.  SECOND CLAUSE –  Tour Alterations

The operator reserves the right to cancel or modify the tour itinerary due to force majeure or acts of providence such as wars, internal commotion, protests/strikes, terrorism, fire, natural disasters, public authority decisions, or any other extreme circumstances; this may include substitution with a comparable yacht, guide, hotel, transport, meals, sightseeing destinations.

3. THIRD CLAUSE – Payment

In order to make a reservation, we require a deposit, and your payment schedule will then be discussed with your travel adviser. Full payment must be made prior to the start date of your trip.

We will not send confirmations, vouchers or flight tickets until the full balance has been received, and we reserve the right to cancel your trip if full payment is not received prior to the start date.

Prices, surcharges and credit card charges

All prices we advertise are accurate at the date published/advised, but we reserve the right to change any of those prices prior to booking. Before you make a booking we will give you the up-to-date price of your chosen programme including the cost of any peak-season supplements, upgrades or additional facilities which you have requested.

For all payments made by credit card through PayPal, a 6% service fee will be added to the cost. The additional costs for every transfer made out to Nicky Lodgeabout our Cuyabeno programs or if you want to book a tour, Ecuadorian Taxes and bank transfer fees, will have to be paid by you, the client.

We are obligated tu charge 12% IVA for every payment realised by Ecuadorian citizens.

4. FOURTH CLAUSE –  Insurance

Adequate and valid travel insurance is compulsory for all Nicky Lodge travellers. It is a condition for accepting your booking that you agree to have obtained adequate and valid travel insurance for your booking by the date of commencement.

  1.  FIFTH CLAUSE  – Visa, Health, Passport, Travel documentation

Whilst we are able to provide basic advice to clients regarding passports and visa requirements, you should check with the appropriate Embassy, Consulate or Foreign Office for the exact requirements for your chosen programme and date of travel. It is your responsibility to ensure that you have the correct passport and visas to gain access to Ecuador. If you fail to do so, we have no liability to you for any cost, loss or damage which you suffer, nor will we refund you the cost of any unused portion of your travel arrangements.

We cannot accept responsibility for any failure to comply, resulting in any costs or fines being incurred and we advise you to check with your passport office or the consulate in question if you have any queries.

We are able to offer advice on mandatory health requirements; however, we are not medical experts. It is your responsibility to ensure that you obtain proper and detailed medical advice at least two months prior to travel for the latest health requirements, recommendations for your destination and any costs. If you do not do so and are either not allowed to enter any country, or suffer personal injury or death as a result, we have no liability to you for any cost, loss or damage which you suffer nor will we refund you the cost of any unused portion of your travel arrangements.

Clients with existing medical problems, pregnant women and anyone who has recently visited other countries should check requirements with their general practitioner.

  1.  SIXTH CLAUSE – Behaviour

A booking is accepted on the strict understanding that you will comply with the laws, customs, foreign exchange, drug and all other regulations of Ecuador, as well as all hygiene, safety and security rules. If you commit any illegal act at the time of booking or if the guide considers your behaviour to be disruptive, threatening or abusive or is causing or likely to cause danger, distress or annoyance to others (reasonable opinion) we may terminate your travel arrangements without any liability on our part.

If this occurs, you will become responsible for your own return transport. If you are affected by any condition, medical or otherwise, that might affect your or other people’s enjoyment of the program, you must advise us of this at the time of booking.

  1.  SEVENTH CLAUSE – Participation Requirements

All clients are expected to declare prior to booking that they are fit and able to complete the itinerary of their chosen program. Anyone suffering from mobility impairment, illness or disability or undergoing treatment for any physical or medical condition must declare the true nature of such condition at the time of booking and make arrangements for the provision of any medication or other treatment which may be required during the program.

8. EIGHTH CLAUSE – Damage & Loss

In case you, the client, looses or damages any property or equipment provided to you, you will have to pay the total amount for a replacement or the repair of the lost or damaged property or item.

9. NINETH CLAUSE – Complaints Policy

At Nicky Lodge we make every effort to give you the best quality of service in our tours. Should you experience any issues, please inform the guide as soon as possible in order to give us the opportunity to find a rapid solution during your tour. In circumstances where you have received less than satisfactory service or are unhappy with our product, we would appreciate written notice so we can investigate. Thank you for cooperating with our procedures and we will endeavour to resolve your complaint in a fair and timely fashion.

10. TENTH CLAUSE – Refunds

Nicky Lodge will act as an intermediary in negotiating refunds with the operator on behalf of you, the client. In no case can Nicky Lodge guarantee a successful response or refund from the operator.

Will not be responsible for giving refunds in any of the following situations:

–      Changes to itinerary before or after departure.

–      Mechanical issues affecting any form of transport on the trip.

–      Substitution of facilities or personnel.

–      Late arrival or no-show of you, the client.

–     Your decision to leave the tour early or miss any activities / meals / accommodations / services during the tour.

–      The client travelling without necessary documentation including passport, visas, immigration papers or vaccination certificates.

–      Price differences paid by different passengers aboard the same tour including special last minute rates.

–      Decisions by any third party that affect the normal running of the tour including by the operator, Ecuadorian government or national park authority.

–      Any other circumstances on your tour arising beyond the control of Nicky Lodge.
